Description
Per Curiam. Plaintiff-Appellant, Sam Williams, Jr. ("Williams"), appeals from the district court's summary judgment dismissal of his 42 U.S.C. § 1983 prisoner's civil rights action. Williams alleges that his First, Eighth, and Fourteenth Amendment rights were violated by officials*fn1 ("defendants") at the Alger Maximum Correctional Facility (the "Alger Facility"). The defendants moved for dismissal of the claim pursuant to Fed. R. Civ. P. 12(b)(6), failure to state a claim upon which relief can be granted. In the alternative, the defendants moved for summary judgment pursuant to Fed. R. Civ. P. 56(b). The district court relied on materials outside of the pleadings and granted the defendants' motion for summary judgment. For the reasons stated below, we AFFIRM the district court's summary Disposition.
