The case was tried to a jury which returned a verdict in favor of the plaintiff and the defendant has appealed. The case is now making its second appearance before this court. Our decision in the former appeal is reported in Williams v. Benefit Trust Life Ins. Co., 195 Kan. 579, 408 P.2d 631, to which reference will be made as occasion demands.
